To All:

This is just a reminder that as of January 1st 2012 all lead sinkers and jig heads under 1 oz. WILL BE ILLEGAL! in the State of Massachusetts. This includes all jigs used for jig & pig techniques. It also includes any other sinker used. It will be strictly inforced. I don't know as yet what the fine is, but be aware.

 

If you have any quesions I would advise calling Fish and Wildlife. I can try to answer any you have also.

Henry, what is your take on the wording in the law? It says that spinner baits and buzzbaits are legal but then in there definition of a jig it says that a jig is any lead weighted hook,Confused which is illegal, which makes spinnerbaits and such illegal, so in my opinion it will be up to what ever mood the EPO is in at the time as to if you are legal or not, it would have been nice if they followed N.H. law Frown

I agree with mossboss on this they should have followed NH but no they had to try and do one better and all for 32 nesting pairs of loons! It would be nice if they cared for the people that live in this state as much as they the loons. I really doubt that this is going to be strictly enforced either because they would have to actually catch you in the act of using  lead to ticket you. I would like to know how they even plan on testing for lead out in the field. If I paid $6 for a tungsten jig they better not think they are just going to riun it by scraping the finish off it to test it unless they plan on reimbursing after they get done testing it and I''m in compliance.

You are correct on the wording of the law. But it is very specific. You are reading between lines and you can't do that. It specifically says spinnerbaits and buzzbaits are exempt. But it says lead headed jigs with a hook are illegal. They tell you buzzbaits and spinnerbaits are ok. It's not open for interpritation.

Ok mossboss, let me see if I can make this a bit clearer. Let's first pull up the definitions of what we are discussing directly from Regulation (CMR 321 4.01(4):

 

Regulation (CMR 321 4.01(1) Definitions:

 

Lead Jig means any lead-weighted hook which has a mass of less than one ounce.

 

Lead Sinker or Lead Weight means any sinker or weight made from lead and which has a mass of less than one ounce. The term lead sinker shall not include any other sinkers, weights, fishing lures or fishing tackle including, but not limited to, artificial lures, hooks, weighted flies, and lead-core or other weighted fishing lines.

 

Ok, so looking at that it clearley defines what a Lead Jig is, you can't read into it by saying spinnerbaits and buzzbaits are lead weighted hooks. They are more than just a hook with a weight. So maybe that will clearify that. Chatterbaits, of the category of a bladed jig would also be considered a lure not a jig, as they are more than just a weighted hook. Loons don't eat spinnerbaits, buzzbaits or chatterbaits because of the additional parts on the bait. But a loon could eat a jig with a skirt just as easily as without. That is the reason for this law. The science on this is not exact however and both sides are arguing if this is truly a problem for loons or something made up by tree huging hippies.

 

The second definition is also straight forward. Let me know if this helps.
